If your license has been taken from you as a result of a DUI conviction or, as a result of having refused to take a breath or blood test or having failed such a test, you may wish to inquire as to your eligibility for a hardship license.
These restricted licenses are not provided by a court but are provided by the Drivers License Bureau. If the Drivers License Bureau does not believe you qualify for a hardship license it is not required to give you one.
If you have not been convicted of the crime but your license has been taken from you because you refused to take the blood or breath test or failed the test, you may still be eligible for a hardship license. Once again, this is provided by the Drivers License Bureau.
There are several requirements to be eligible for a hardship license and it will be helpful to discuss with the Drivers License Bureau what documents you will need to provide before applying. It may also be helpful to discuss the matter with an attorney experienced in the area.
