Personal Service on an Individual

If your ex-spouse is failing to pay alimony or child support, is not living up to the rules of your divorce decree regarding visitation rights, or is failing to comply with any another agreement in your legal divorce settlement, this is the time to have the help of an experienced Orlando enforcement and contempt attorney.

The law in Florida requires you to file a motion with the court, explaining what your ex-spouse has failed to do. This is done by completing a motion for civil contempt/enforcement form, which you must file with the clerk of the circuit court. Then a copy of the form has to be personally served by a sheriff or private process server. Mailing the form may be considered inadequate, and the instructions for using the form urge you to have it delivered in person.

Why Hire an Orlando Family Lawyer?

Filing this motion with the court and personally serving your ex-spouse is a technical area of the law. This is an appropriate time for you to have the help of an experienced Florida family law attorney.

After your motion is filed, the court will set a hearing. Your lawyer can help you through the local rules of this procedure. Once you know the time and date of your hearing, you will need to complete one of three Florida forms:

  • Notice of Hearing on Motion for Contempt/Enforcement form
  • Notice of Hearing (Child Support Enforcement Hearing Officer)
  • Notice of Hearing Before General Magistrate
